POLICY
1. Purpose
The purpose of these Terms and Conditions (the “Terms”) is to set forth the rights, obligations, and responsibilities between NEXON Korea Corporation or the entity that operates the competition (hereinafter referred to as “NEXON”) and the Member, and other necessary matters concerning the use of the NYPC website and related services (hereinafter referred to as the “Services”) provided by NEXON.
2. Definition of Terms
The terms used in this Terms are defined as follows:
“Member” means a person who has agreed to these Terms, registered for the Services, and uses the Services provided by NEXON.
“Services” means the participation application process and all related ancillary services provided by NEXON to the Member through the NYPC website.
“Participant” means a person who applies to participate in a competition (e.g., Rookie Track, MasterTrack) through the Services and participates in accordance with the competition procedures.
“Competition” means the online/offline rounds, preliminary/final rounds operated by NYPC, and all accompanying programs.
“Application” means the act of a Member registering for the annual Competition through the website after having understood the competition participation methods and requirements of these Terms.
“Content” means any text, images, files, code, data, and all other information (including competition submissions) that a Member posts, uploads, or submits to the Services.
“Operating Policy” means policies separately notified within the Services, such as announcements, FAQs, guidelines, competition rules, eligibility requirements, and criteria for handling misconduct. By agreeing to these Terms, the Member agrees to be subject to each individual Operating Policy.
Except as defined in Paragraph (1), the definitions of terms used in these Terms shall be based on the relevant laws and regulations.
3. Effect and Amendment of the Terms
These Terms shall become effective when it is posted on the NYPC website or otherwise announced, and the Member agrees to it. A Member who agrees to these Terms and registers for membership shall be subject to the Terms. In the event of an amendment to the Terms, the Member shall be subject to the amended terms from the time the amendment becomes effective.
Agreeing to these Terms shall be deemed as agreeing to periodically visit the website to check for any changes to the Terms.
NEXON may amend these Terms. In the event of an amendment, NEXON shall specify the content and effective date of the amended Terms and post it on the NYPC website at least seven (7) days prior to the effective date. However, if the changes are unfavorable to the Member, NEXON shall notify the Member by posting it online on the NYPC website at least thirty (30) days prior to the effective date or by sending it to the e-mail address registered by the Member during membership registration. The amended Terms shall take effect from the posted or notified effective date.
The Member has the right to refuse the amended Terms. A Member who objects to the amendment of these Terms may discontinue using the Services and withdraw their membership. If, when announcing the amended Terms, it is also announced that the Member's failure to express consent or refusal will be deemed as acceptance, and the Member does not express their refusal by the effective date, the Member may be deemed to have agreed to the amended Terms.
4. Provision and Change of Services
NEXON may provide the following services to Members:
Use of the NYPC website (notices, guidance, viewing materials)
Membership registration and account management
Competition application and participant management
Guidance for competition operation (e.g., email/text messages) and related materials
Other services as determined by NEXON
NEXON may change all or part of the Services for operational or technical needs.
5. Application for and Method of Service Use
A person who wishes to use the NYPC Services provided on the NYPC website must apply for NYPC membership (hereinafter referred to as 'Application for Use') in accordance with the procedures provided on the website, along with consent to the contents of these Terms.
A person who wishes to become a Member must provide all information requested by NEXON at the time of Application for Use.
A person who wishes to become a Member must provide their true and accurate information in accordance with relevant laws at the time of Application for Use and consent to NEXON's collection of the registered information. The Member must provide accurate information upon registration. If the Member provides a false name or identity or uses another person's name, the Member cannot claim their rights under the Terms, and NEXON may cancel or restrict Service use and Competition participation.
Once a Member acquires membership rights through the Application for Use in Paragraph 1, the Member shall be managed by NEXON through the account, and the Member may use the Services provided on the NYPC website in accordance with relevant laws and these Terms.
Children under the age of 14 as of the date of application are restricted from applying for and participating in the Services.
NEXON may request additional identity verification, such as checking an ID card, at a certain point (e.g., for participation in the final round) for the purpose of competition operation and prevention of misconduct.
In the event that a Member uses services provided by NEXON through collaboration with a third party, such Member may be required to provide separate consent to the terms of use for such services as provided by NEXON or the third party.
6. Acceptance and Restriction of Application for Use
NEXON shall, in principle, approve an application for use by any person who consents to these Terms and wishes to become a Member, provided that such person submits accurate and true information in the application, unless there is a legitimate reason not to do so. However, Nexon may refuse to approve an application for use, or cancel such approval after the fact, if any of the following applies:
If the application is made in violation of Article 5 of these Terms.
If the applicant's age is not suitable according to Article 5, Paragraph 5 of these Terms.
If the application is made for the purpose of engaging in acts prohibited by relevant laws.
If a membership has already been completed with an ID under the applicant's own name.
If the applicant intends to use the NYPC Services for an improper purpose or for commercial gain.
In the event that a Member applies for re‑registration after having withdrawn from the service while under a temporary suspension imposed for the purpose of investigating a violation of these Terms or applicable laws
In any other case equivalent to the above, where acceptance is deemed inappropriate.
NEXON may withhold acceptance in any of the following cases until the reason is resolved:
If there is a lack of capacity in NEXON's facilities or if there is a technical issue.
If the person wishing to become a Member has not followed the form or procedure for application provided by NEXON.
If the person wishing to become a Member has not completed the procedures essential for the application in accordance with relevant laws.
In any other case that is analogous to the circumstances set forth above, where approval of the application for use would be unreasonably difficult or inappropriate.
7. NYPC Participation and Operation
Members who wish to participate in NYPC shall submit an NYPC application form, duly completed with the information requested by NEXON, to NEXON.
At the time of submitting the NYPC application, the Member shall accurately and up‑to‑date enter all personal information required for the application, as well as any other information requested by NEXON. The Member shall be solely responsible for any issues arising from inaccurate information provided, and if the Member submits false information, including misuse of another person’s information, the Member’s qualification to participate in NYPC may be revoked.
NEXON may, without prior notice, change any information entered by the Member that may defame others or violate good public morals or other social order into arbitrary characters and then notify the Member.
If a participant under the age of 19 applies for NYPC, NEXON may request the consent of their legal representative.
Members shall bear all responsibility for any disadvantage resulting from inaccurate or incorrect information entered by them. NEXON shall not be liable for any losses, damages, or disadvantages arising therefrom, provided that this limitation shall not apply in cases of willful misconduct or gross negligence on the part of NEXON.
NEXON may establish requirements for participation in the competition (hereinafter referred to as “Eligibility”) for the fair operation of the Competition. Details regarding eligibility and exceptions shall be stipulated in a separate Operating Policy or announcement.
8. NYPC Participation Guidelines (Rules, Unfair Conduct, and Sanctions)
The Competition rules, schedule, participation procedures, submission methods, scoring methods, ranking calculation, award criteria, misconduct criteria, and sanctions shall be governed by the Operating Policy.
If NEXON confirms any of the following acts of misconduct by a Member during or after the NYPC Competition, including the preliminary and final rounds, NEXON may revoke the Member's eligibility to participate and cancel any awards. NEXON may also restrict the Member's future participation in the Competition. If a Member's misconduct disrupts the normal operation of the Competition, NEXON may take legal action against the Member and claim compensation for direct or indirect damages incurred by NEXON.
Disclosing or leaking Competition questions, related algorithms, solutions, or source code online or offline during the Competition.
Discussing Competition questions, related algorithms, solutions, or source code with others online or offline.
Inquiring about Competition questions, related algorithms, solutions, or source code online or offline.
Providing or receiving Competition questions or source code to or from others.
Referring to or copying source code that was created after the start of the Competition or for which the Member does not have usage rights.
Having another person take the test on one's behalf or arranging for another person to do so.
Providing one's own ID and password to others or disclosing them online or offline.
Participating in the Competition with multiple IDs by the same person.
Participating in the Competition using another person's personal information.
Interfering with another person's participation in the Competition.
Disrupting the normal operation of the Competition and its systems, or engaging in system attacks or hacking.
Using a Large Language Model (LLM) to generate and test a large number of results in an automated manner and submitting them as answers.
Any other act that can be generally considered as misconduct.
NEXON may review submitted code and, if it is determined that there is a significant similarity in the code, may disqualify the relevant Member and, if necessary, request confirmation from the Member.
If a Member provides false information during membership registration or participation, NEXON may restrict all participation in the Competition and the provision of benefits (such as awards, merchandise, etc.).
9. Rights to Content
All intellectual property rights in the submitted materials belong to the Member. However, the Member grants NEXON the authorization to use the submissions, including by providing them to third parties, for the purposes of operating and judging the competition. In addition, the Member grants NEXON the authorization to use the winning submissions, including the authorization to prepare derivative works, for the promotional purposes of NEXON or NYPC.
The Member warrants that the Content they post/submit does not infringe on the rights of any third party. The Member is solely responsible for any violation or infringement arising from or in connection with the Content posted/ submitted by the Member. In the event of a dispute, it will be handled in accordance with relevant laws and the Operating Policy.
Except in the cases specified in Paragraph (1), NEXON shall not provide or disclose the contents of submissions to any third party without the Member's consent and shall take appropriate measures to maintain the confidentiality of the submissions.
10. Promotion by NEXON
NEXON may create and use promotional materials such as articles, photos, and videos for the promotion of NYPC. The Member grants NEXON the authorization to use the Member's likeness, name, and posts to the extent permitted by relevant laws to include in these materials as NEXON deems necessary.
NEXON may reproduce and edit the promotional materials mentioned in the preceding paragraph and post them on its official website and various social media platforms, or use them as materials for related online and offline promotional content and for press and broadcast reports.
11. Notices and Guidance to Members
When NEXON provides notices to Members for the operation of the Competition and provision of services, it may do so via the email address or mobile phone number designated by the Member. The procedures for obtaining consent for the collection and use of personal information for this purpose shall be in accordance with the Service's Privacy Policy.
The procedures for consenting to and withdrawing from the receipt of advertising information shall be in accordance with the Service's Privacy Policy and a separate consent page.
When providing notice to all Members, NEXON may substitute the notice in Paragraph (1) by posting it on the website for at least seven (7) days or by presenting it in a pop-up window.
12. Member Withdrawal
A Member may apply for withdrawal from membership at any time using the method provided within the Services. If a Member applies for withdrawal, NEXON may verify the Member's identity. If the identity is confirmed, NEXON will take action according to the Member's request. The management of personal information upon withdrawal shall be in accordance with the Privacy Policy.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or the use of the Service shall be exclusively resolved by the competent courts of Seoul, Republic of Korea, to the extent permitted by applicable law.
The Parties agree to use their best efforts to resolve any disputes amicably through good‑faith negotiations before initiating any formal legal proceedings. If resolution cannot be reached through negotiation, either Party may pursue its legal remedies in accordance with the procedures set forth above.
Nothing in this section shall prevent either Party from seeking injunctive or other equitable relief in any competent court to protect its intellectual property rights or address violations that may cause irreparable harm.
14. Other Provisions
NEXON shall not be liable for any injury, damage, or other harm that occurs during participation in NYPC due to the Member's carelessness or for reasons not attributable to NEXON.
NEXON shall not be liable for any failure or delay in information processing or transmission due to errors in the internet, devices, equipment, software, or other technical problems not attributable to NEXON. The responsibility for submitting materials in a timely and appropriate manner and format lies with the Member.
If a Member violates these Terms or otherwise interferes with the normal and lawful operation of NYPC, NEXON may hold the Member responsible for the resulting damages.
The Member has the right to have their personal information protected, as well as the obligation to protect themselves and not infringe on the information of others. Members should be careful not to leak their personal information, including their password, and should be mindful not to damage the personal information of others, including in posts. Failure to fulfill these responsibilities may result in punishment under relevant laws.
NEXON shall endeavor to protect the Member's personal information as prescribed by relevant laws. The protection and use of Member's personal information shall be in accordance with relevant laws and NEXON's separately announced Privacy Policy.
